The Texas legislature is officially in its second special session that Governor Abbott has called for. The session began on August 15, 2025, and there have been several bills filed since.

One of the issues addressed early in the second special session is the tragic flooding that took place over July 4 this year. Camp safety and flood preparedness are major topics being addressed in the Senate.

Another issue that the Senate has been quick to act on is the issue of THC consumables in Texas. Once again, the THC industry is going to have its work cut out for it.

THC Ban Bills Dominate the Debate

Already, the Senate has seen Senate Bill 6 (SB 6) introduced. It is, in effect, a ban on all THC products. It has already had a public hearing, passed through committee, and received a preliminary vote, where it passed.

The House has a similar bill, House Bill 6 (HB 6), that basically does the same thing. It would ban everything but CBD and CBG. That would spell the end of low-THC products in Texas. The latest on HB 6 is that it has been referred to Public Health.

When Governor Abbott vetoed Senate Bill 3 (SB 3) during the regular session, he called for the regulation of these low-THC products in Texas instead of an outright ban. The Governor stated that he would like to see it regulated much in the same way that alcohol is.

Regulation vs. Ban: The Future of THC in Texas

Despite there being lawmakers who are interested in regulating the THC and hemp market in Texas, the push to outright ban these products remains and seems to have gained traction.

As the second special session begins, it will be interesting to see if any lawmakers pushing for regulation will be able to get any support over these bans.
