Borger Drug Bust Suspect Brags About Dropped Charges; Police Chief Sets Him Straight
It's criminal defense 101: keep your mouth shut.
But sometimes, people just need to talk, and that's what gets them in trouble.
Hutchinson County Mugshots page recently posted the booking photo for Xavier DeWayne Cunningham, 39. Cunningham was arrested on a charge of Evading Detention and Possession of a Controlled Substance PG1 >=400g.
His passenger, Christopher Istre, was also arrested and booked on a charge of Possession of a Controlled Substance PG1 >=400g.
Cunningham posted his $155,000 bond and seemingly took to Facebook as soon as he was released, commenting on his booking photo that his charges had been dropped.
Cunningham can be seen conversing with other commenters and exchanging phone numbers. Then, an unexpected visitor to the page makes an appearance, Borger Police Department.
The comment swiftly and hotly disputes Cunningham's statement of his charges being dropped (or refused at intake, in more technical terms). Jail records confirm that Cunningham was released on surety bond and do not indicate that the charges were refused.
Rather than insisting that Cunningham will face charges, BPD informs the suspect that the charges have not been dismissed but are merely pending for prosecution and will potentially result in more charges once a full investigation is completed. The comment is sewn up with a pointed reminder that there are recordings from body and in-car cameras available and that if one should have any concerns the Chief of Borger Police Department would more than willing to hear them.
Soon after the exchange, a press release from Borger Police.Department was issued that contained further details of the arrest. At the time of this writing, Cunningham has yet to leave a comment on this post.
