What Is The Easiest Way For You To Get Married In Texas? Say You Are.
Texas is a state known for having interesting and sometimes strange laws. Some of those laws, it can be argued, make certain things needlessly difficult or confusing, while others make things incredibly simple. When it comes to getting married in the Lone Star State, the common law marriage law makes it insanely easy for you to be living "til death do you part".
How Does Common Law Marriage Work In Texas?
Common law marriage in the state of Texas is pretty straightforward. Digging online, I saw numerous articles claiming that to be married by common law in Texas, all you have to do is get together with your partner and claim you're married three times. I thought this had to be a myth, and did some research. It turns out that this isn't that far from the truth.
According to the Texas State Law Library, the things you need to do to be considered married are:
- Agree to be married
- Live together in Texas as husband and wife
- Represent to others that you're married
There are a couple of other stipulations like the two people not being related and you need to be at least 18 years of age. You can find out more by following this link. All you really have to do is live as a married couple and act like a married couple to be married by common law.
How Long Do You Have To Live Together To Be Married By Common Law In Texas?
A lot of people think there is an amount of time that you have to live together before you're considered to be in a common-law marriage. This actually isn't true. There isn't a timeframe given.
It's a little mind-boggling when you sit down and think about it. Just present to the people around you that you and your significant other are married, and you are. If you feel the need to go down to the county clerk to make it official on paper, you can. It's a pretty simple process. Other ways of proving marriage under common law I've seen mentioned a lot include filing your taxes jointly or being on a health insurance plan together.
Word of caution; common law marriage is taken as seriously as a traditional marriage and that means if things go south you will have to go through a divorce just like every other couple. Don't think because it's easy that common law marriage isn't just as binding. There's also the pesky business of proving the marriage existed.
