Different Degrees Of Murder In Texas

Murder isn't as cut and dry as you might believe. We've all heard of people being charged with different degrees of murder, but how many of us have ever stopped to figure out what they mean? The varying degrees of murder in Texas are:

  • First Degree - Capital murder and the most serious degree. The defendant intentionally or knowingly caused the death of another person. Interestingly enough, that includes people who hire someone to do the killing for them.
  • Second Degree - "Murder" and is a first-degree felony unless it's proven that the act was a crime of passion.
  • Third Degree - You've probably only heard of this one in the movies. That's because it only exists in a handful of states, and they don't include Texas.

Not even the term homicide is cut-and-dry. There are varying degrees of homicide in the Lone Star State. They are:

  • Murder
  • Capital Murder
  • Manslaughter
  • Criminally Negligent Homicide
