The fate of THC in Texas has been dominating headlines for most of 2025, and the battle is far from over. In the current special session that was called for by Governor Abbott, legislators are still pushing for a full ban.

Bills have been introduced in the House and the Senate that would ban all THC products in the Lone Star State. On July 30, 2025, the Senate bill, SB5, received a vote.

What Senate Bill 5 Means for Texas

In the vote, the Senate approved the bill, which is now headed for a final vote. If the bill passes in the Senate, it will go to the House, where an almost identical bill, HB5, was introduced earlier this month.

Governor Abbott vetoed a bill that would have banned low-THC products in Texas during this year's legislative session. He stated that he would rather see these products regulated rather than outright banned, similar to how alcohol is regulated in the state.

There are several other bills dealing with hemp and low-THC products that have been filed, most of which align more with the Governor's wishes than SB5 and HB5.

What Comes Next for THC Laws in Texas?

It will be interesting to see what happens if SB5 makes it to the House. There are several bills aimed at regulating these products, and even one that seeks to legalize small amounts of cannabis for adults, HB195.

Regulations being suggested include warning labels, child-proof packaging, and selling to only those who are 21 and older.

The special session lasts for 30 days, and it's hard to imagine that the debate over THC in Texas won't get more intense.
