Texas legislators keep pushing the state closer to a THC ban. In the current special session, another bill has been introduced that would only allow CBD and CBG products to be sold in the Lone Star State.

If that sounds familiar, it's because it is almost identical to a bill introduced early in the special session titled Senate Bill 5. This new bill is the House version of that bill.

House Bill 5 (HB5) was introduced on July 28 in the Texas House of Representatives. Once again, advocates and business owners are on high alert.

2025 is becoming marked by the battle over THC and consumable hemp products in Texas. During the legislative session, the debate over whether or not to ban THC dominated headlines.

Abbott’s veto and push for regulation

Petitions to stop the ban gathered thousands of signatures. The Governor's office was flooded with letters from people opposing the ban. Eventually, Governor Abbott vetoed the bill that outlawed all low-THC products and called instead for regulation.

One of the tasks given to lawmakers during the special session was to create legislation to regulate the already existing multi-billion-dollar industry. The Governor wanted to see these products regulated similarly to how alcohol is in the state.

Texas special session shifts THC debate

Senate Bill 5 was unanimously passed in committee, and debate on the bill will take place once the Senate reconvenes on July 30. House Bill 5 has yet to be heard.

There is a slight glimmer of hope for those against the ban. Bills have been filed in the special session that align more closely with the Governor's request for regulation. They address labeling, packaging, and the sale of these products to anyone under the age of 21.

The special session only lasts for 30 days. There's a lot for them to accomplish in a short amount of time before we learn the fate of THC in Texas.
